What are OSHA 300 logs?

The OSHA 300 Log is the record maintained by the employer of recordable injuries and illnesses that occur on the job. The full log contains the department and job of the worker, a description of the injury or illness, and the number of lost days or restricted days that occurred as a result of the injury or illness.  Employees, employee representatives, and former employees have a right to obtain a copy of the log.  The OSHA 300 Log must be maintained for five years.  To obtain a copy of the OSHA 300 Log, please visit www.osha.gov/recordkeeping/new-osha300form1-1-04.xls.

SAMPLE Employee Request for OSHA 300 Logs

RE: OSHA 300 Logs

Dear:

Pursuant to Federal OSHA regulation, 29 CFR 1904, as an employee of (name of company), I am requesting a copy of the log and summary of recordable occupational injuries and illnesses, OSHA Form 300, for the entire establishment.  I am requesting the logs for year ______ to _______ (logs going back 5 years can be requested). As per the OSHA regulation, I expect you to fulfill this request by the end of the business day following your receipt of this request. Also, as required by the law, I expect to receive the entire log, with no information removed, except for allowed “privacy cases” as defined in the OSHA regulation. Please mail these records to me at _____________________ (fill in address).

Pursuant to Federal OSHA Regulation 29 CFR 1904, as the authorized bargaining representative of   _____________________ , UFCW Local No.___ hereby requests that a copy of the log and summary of recordable occupational injuries and illnesses, OSHA Form 300, for the years  ____   to ____  (logs going back 5 years can be requested) be made available to the union. As per the OSHA regulation, we expect you to fulfill this request by the end of the business day following your receipt of this request.  Also, as required by the law, we expect to receive the entire log, with no information removed.

SAMPLE Obtaining Information on Exposure to Toxic Substances

 Plant Manager

Dear (Name of Plant Manager):

As the authorized representative for the employees at (name of plant), and pursuant to Federal OSHA Regulation 29 CFR 1910.1020 (Employee Access to Exposure and Medical Records Standard) and 29 CFR 1910.1200 (OSHA’s Hazard Communication Standard), UFCW Local No. _____ requests copies of all the following:

1.       List of toxic chemicals used in the plant;

2.       Results of any exposure monitoring for toxic substances conducted by the company or by consultants hired by the company;

3.       Copies of Material Safety Data Sheets which you have on file for chemicals used in the plant; and

4.       Copies of any reports, findings, analyses, conclusions or recommendations made by any health and safety consultant hired by the company, or made by the company itself, relating to plant employee exposure to toxic substances.

We note that the above-requested information is necessary to assess employee exposure to toxic substances and to assure that employees’ health is being adequately protected by company safety practices.

OSHA standards 29 CFR 1910.1020 and 1910.1200 require either that we will be given copies of this information within 15 days at a convenient time and place, or if you cannot reasonably provide access to these records within 15 days, you must apprise us of the reason for any delay and the earliest date when the records can be made available.
